Terms of Service

Welcome to HatchMatch. These Terms of Service ("Terms") govern your use of the HatchMatch mobile application ("the App"), operated by Chad Stauffer (doing business as HatchMatch). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old to use HatchMatch. By using the App, you represent that you meet this age requirement. If you are between 13 and the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.

2. Your Account

You may use HatchMatch as an anonymous user with limited features, or you may create a permanent account by signing up with email and password or with Sign in with Apple. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You agree to provide accurate information when creating an account and to keep that information current. You may delete your account at any time from within the App.

3. The Service

HatchMatch provides AI-powered identification of flies, insects, and fly fishing patterns from user-submitted photos. The App is provided for informational and recreational purposes related to fly fishing.

Identification Accuracy

HatchMatch uses computer vision technology to suggest possible identifications. Identifications are suggestions, not guarantees. Accuracy varies based on photo quality, lighting, angle, and the inherent limitations of automated identification. You should use HatchMatch as one of multiple tools when making fishing decisions, and should not rely solely on its output for any consequential choice.

Service Availability

We strive to keep the App available and functioning, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, technical issues, or factors beyond our control.

4. Acceptable Use

When using HatchMatch, you agree not to:

• Use the App for any illegal purpose or in violation of any applicable law
• Attempt to reverse engineer, decompile, or otherwise tamper with the App
• Upload photos containing illegal, harmful, or inappropriate content unrelated to fly fishing
• Upload photos of other people without their consent
• Attempt to circumvent the App's token system, paywall, or other access controls
• Use automated systems (bots, scrapers) to access the App
• Impersonate another person or misrepresent your identity
• Resell, redistribute, or commercially exploit the App without our written permission

We reserve the right to suspend or terminate accounts that violate these terms.

5. Tokens and Subscriptions

HatchMatch uses a token-based system for fly identifications, plus optional subscription tiers for unlimited use. Pricing and product details are displayed in the App and may change over time.

Free Tokens

New users receive a limited number of free tokens upon account creation. Free tokens are provided as a courtesy and may be modified or discontinued at our discretion.

Token Purchases

Token packs are non-refundable consumable in-app purchases. Tokens do not expire under normal circumstances but are non-transferable and have no cash value. We reserve the right to retire token packs or adjust pricing for future purchases (existing balances remain valid).

Subscriptions

Subscriptions provide unlimited identifications during the subscription period. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the period ends. You can cancel your subscription at any time through your iOS device's Settings → [Your Name] → Subscriptions.

Refunds

All purchases are processed by Apple through the App Store. Refund requests must be submitted directly to Apple per their App Store refund policies. We do not process refunds directly and have no control over Apple's refund decisions.

Price Changes

We may change subscription pricing at any time. Existing subscribers will be notified of price changes before they take effect, in accordance with Apple's policies. You may cancel your subscription if you do not agree to a price change.

6. Your Content

You retain ownership of the photos and content you upload to HatchMatch. By uploading content, you grant HatchMatch a worldwide, non-exclusive, royalty-free license to store, process, display (to you), and transmit your content as necessary to provide the App's services. This includes transmitting photos to OpenAI for identification processing.

This license is limited to operating the App. We will not use your photos for marketing, advertising, training of public AI models, or any purpose beyond providing the service to you, without your separate consent.

You represent that you have the right to upload any content you submit to HatchMatch and that your content does not violate any third party's rights.

7. Intellectual Property

The HatchMatch App, including its design, code, branding, copy, and overall look and feel, is the property of Chad Stauffer and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

The HatchMatch name and logo are trademarks of Chad Stauffer.

8. Third-Party Services

HatchMatch integrates with third-party services (Apple, Supabase, OpenAI, RevenueCat) to operate. Your use of HatchMatch is also subject to the terms and policies of these third parties where applicable. We are not responsible for the practices, policies, or actions of third-party services.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be error-free or uninterrupted
• Identifications produced by the App will be accurate, complete, or reliable
• The App will meet your specific requirements or expectations
• Any information obtained through the App will be useful for any particular purpose

You use the App at your own risk. Fly identification provided by HatchMatch is for informational purposes only and should not be the sole basis for fishing, conservation, or scientific decisions.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHAD STAUFFER (AND ANY AFFILIATES, CONTRACTORS, OR SERVICE PROVIDERS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APP EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO HATCHMATCH IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

This limitation applies whether the claim is based on contract, tort, negligence, strict liability, or any other legal theory. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Chad Stauffer from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any third party's rights.

12. Termination

We may suspend or terminate your access to HatchMatch at any time for violation of these Terms or for any other reason at our discretion. You may stop using the App at any time and may delete your account from within the App.

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this document and, for material changes, notify you within the App. Your continued use of HatchMatch after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of HatchMatch will be resolved in the state or federal courts located in California, and you consent to the exclusive jurisdiction of those courts.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chad Stauffer regarding HatchMatch and supersede any prior agreements.
